Is it Considered Hersey to Not Rule by the Torah?

I have a question. In Judaism, or more specifically, in the Torah, is it considered hersey to not rule by Mosaic Law? If it is, is it akin to apostasy, or is someone still within the folds of Judaism if they don’t rule by it? For example, establishing a secular court. Is this considered hersey/ apostasy?
